ITP

Also known as: Impuesto de Transmisiones Patrimoniales · Transfer Tax

The Spanish transfer tax on resale property purchases — applied to resale apartments, not new-builds. In Andalucía in 2026, a flat 7% rate.

ITP (Impuesto de Transmisiones Patrimoniales) is the Spanish tax applied to the resale purchase of property. It is paid by the buyer at completion. New-build purchases pay IVA + AJD instead of ITP.

In Andalucía, after the regional tax reform of recent years, the standard ITP rate is a flat 7%, applied to the higher of the declared sale price or the cadastral reference value (valor de referencia) set by the Catastro.

Reduced rates apply in specific cases: 6% when the property value does not exceed €150,000 and will be the buyer's habitual residence; 3.5% for buyers under 35, large families, or certain disability cases, within defined value caps (€150,000 / €250,000).

Important: ITP is calculated on the cadastral reference value (a market-aligned valuation set by the Catastro) when that is higher than the declared sale price. This is a recent change. Your lawyer calculates which applies at completion.
